Sacramento man accused of stabbing Amtrak train faces legal capacity hearing – The Vacaville Reporter

A 23-year-old Sacramento man arrested Sunday in Fairfield on charges of stabbing two people on an Amtrak train was arraigned Tuesday in Solano County Superior Court, but a judge stayed the proceedings and scheduled a competency hearing in the coming weeks.

Court and jail records show Brandon Torres-Mendoza appeared before Judge Kelley J. Trujillo in Fairfield as the complaint filed by the Solano County District Attorney’s Office was read.

During a scheduled prison hearing, Torres-Mendoza, a previously convicted felon on parole, was charged with two counts of assault with a deadly weapon (not a firearm), a felony, including one count of causing great bodily harm, among other aggravated counts; robbery; possession of brass knuckles; and resisting arrest, all felonies with separate, multiple aggravated counts.

The public defender represented Torres-Mendoza, whose mental capacity remains in question and who requested a so-called “Medical Opinion No. 1368” after the suspect was questioned by a licensed psychologist or psychiatrist.

Under the law, specifically Section 1368 of the Penal Code, from which the report gets its title, a defendant who is found to be insane and unable to assist in his or her own defense cannot be tried. However, once a determination of competency is made, the trial can be reopened and the defendant can face further legal proceedings, including a preliminary hearing and a jury trial.

Judge Trujillo stayed the proceedings against Torres-Mendoza and then assigned the case to Department 25 in Fairfield, where Judge Janice M. Williams will hear a medical report at 8:30 a.m. October 10 at the Justice Center.

Torres-Mendoza remains in the Solano County Jail without bail and has an outstanding warrant for his arrest from Sacramento County.

According to a social media post by the Fairfield Police Department, on Sunday at approximately 10:30 p.m., dispatchers received a call from an Amtrak train conductor.

The train had just pulled into Fairfield station and the man, later identified as Torres-Mendoza, had apparently stabbed one person on board and was possibly holding another person hostage.

The conductor requested assistance and informed dispatchers that the train would stop at the Fairfield-Vacaville Amtrak station.

While searching for the suspect, officers initially found one victim, a 21-year-old man with two stab wounds to the chest. The individual was taken to a local hospital where he was reportedly in critical condition Sunday evening.

“Police encountered a man holding a knife but quickly realized it was actually a second victim, a 24-year-old who took the gun from Torres-Mendoza and bravely held him at bay until officers arrived,” the post said.

Torres was arrested shortly after 11 p.m. in the 4900 block of Vanden Road, jail records show.

Fairfield police are investigating the crime with the assistance of Amtrak Police.

Investigators said Torres-Mendoza did not know any of the victims, and the motive for the stabbing remains unclear.
